Burglary and Aggravated Burglary under Ohio Law
With regard to the criminal act of burglary, According to ORC §2911.12(A), no person, by force, stealth, or deception, shall do any of the following:
- Trespass in an occupied structure, when another person other than an accomplice of the offender is present, with purpose to commit in the structure any criminal offense;
- Trespass in an occupied structure that is a permanent or temporary habitation of any person when any person other than an accomplice of the offender is present or likely to be present, with purpose to commit in the habitation any criminal offense;
- Trespass in an occupied structure, with purpose to commit in the structure any criminal offense.
Additionally, section (B) of ORC §2911.12 states that no person, by force, stealth, or deception, shall trespass in a permanent or temporary habitation of any person when any person other than an accomplice of the offender is present or likely to be present.
If the alleged offender is accused of violating section (A), they will be charged with a felony of the second degree. If they are accused of violating section (B) they will be charged with a felony of the third degree.
A felony of the second degree comes with a presumptive sentence of up to 8 years in prison and / or fines of up to $15,000. A felony of the third degree comes with a presumptive sentence of up to 5 years in prison and / or fines of up to $10,000.
ORC §2911.11 defines aggravated burglary and states that a person will be guilty of the offense if that person, by force, stealth, or deception, trespasses in an occupied structure with purpose to commit any criminal offense, and the following scenarios occur:
- Inflicts, or attempts or threatens to inflict physical harm to another;
- Has a deadly weapon or dangerous ordnance on or about the offenders person or under the offender’s control.
An aggravated burglary charge is considered a felony of the first degree, which comes with a presumptive sentence of up to 10 years in prison and / or fines of up to $20,000.
